Know Your Rights and Responsibilities as a Landlord

In the City of Henderson, landlords are responsible for any unpaid balance left on a tenant account. Past due balances must be paid to start new service at a property and may ultimately be subject to a lien.

The Henderson Municipal Code 14.17.060.c states: “Collection of delinquent charges. Outstanding bills for water and/or sewer services and related fees shall be charged to the owner of the property should the tenant not render payment in full. Such charge shall constitute a lien upon the property to which the service is rendered, as well as constitute a debt of the record owner(s) of the property and of the person(s) occupying such premises to the city. The lien shall be enforced in compliance with Henderson Municipal Code Title 5.04.050 Sections D and E, Nevada Revised Statutes Chapter 266, and Henderson City Charter Section 2.280.”

Leak Adjustment Program

The City offers a premise-based adjustment in the case of a significant leak. Adjustments consist of splitting the costs of the excess consumption 50/50 between the customer and the City of Henderson. Eligibility is limited to two adjustments in five years for the leak occurrences that are greater than twice the normal consumption. The maximum adjustment period is three billing cycles. The City will match to the highest tier the leak reached.

Program Requirements:

  • Water consumption during leak was more than double that of the same period of the previous year (for up to three billing cycles); AND
  • The leak which caused the high consumption has been repaired; AND
  • Proof of repair is provided (examples include: photos, receipts for labor, parts, equipment, etc.); AND
  • Water consumption has returned to normal for at least one billing cycle; AND
  • Water service has been active in the applicant's name at the location for at least 13 months.

What is AB 356?

A law enacted by the Nevada Legislature in 2021 will prohibit the use of Colorado River water delivered by Southern Nevada Water Authority member agencies to irrigate nonfunctional grass, beginning in 2027.

AB 356 applies to Southern Nevada commercial, multi-family, government and other properties. It does not apply to grass in single-family residences, such as grass in front and back yards.
